Kelly Lake is community in the Peace River Country of northeastern British Columbia, Canada, located just west of the border with the province of Alberta.[1]

The Kelly Lake Cree Nation (KLCN), the Kelly Lake First Nation (KLFN), and the Apetokosan Nation (Kelley Lake Métis Settlement Society) are three different groups claiming to speak for the Aboriginal community of the area. None are recognized by the Canadian government as Aboriginal peoples, though they have been part of land claims in the courts

[2] and are recognized as stakeholders in the Northern Gateway Pipeline region by Enbridge.[3] The BC Assembly of First Nations endorsed the claims of the local people as a First Nation in 2008, supporting the claim that the people of Kelly Lake were wrongly missed during the enumeration of peoples living within the Treaty 8 area.[4] In the 1999 court documents, both the KLCN and KLFN are described as a group of "Beaver, Cree, and Iroquois people".[5] The chief of the KLCN has claimed indigenous rights because of the group's Dunne-za and Nehiyaw ancestry when speaking to a joint review panel on BC Hydro's Site C dam project. He also claimed that the people's traditional territory extends in Alberta. Attached is the Federal Court Decision on the land claim. The following is a list of members who belong to the Saulteau Band located in Moberly Lake, B.C. Who applied and received Indian status in 2001. The leaders of the Kelly Lake First Nation (KLFN),Claire Dean Gauthier and Lyle Edward Campbell aka Letendre also claims to be the leader of the Kelly Lake Metis Settlement Society (KLMSS) aka Apeetogosan Nation. The two individuals sought Indian status through the Saulteau Indian Band and were successful. The cousins had a falling out and Lyle Letendre formed the Kelly Lake Metis Settlement Society established a Territorial Affiliation Agreement with in February 2007 under the Metis Nation of British Columbia (MNBC) Governance Charter Agreement was revoked September 28, 2007 citing many discrepancies, notably the required Indian and Northern Affairs Canada form process through MNBC was not completed. Therefore, the Territorial Affiliation Agreement was revoked. Lyle Letendre acting on his own, with his own family, later would form the Apeetogosan Nation.

Both Claire Dean Gauthier and Lyle Edward Campbell aka Letendre are also listed in the current Indian registry. Both individuals and their siblings and cousins made attempts to make an application in Procedural Law - Civil Procedure - the Federal Court ordered to assess damages against the Crown for breach of fiduciary duty with respect to mineral rights in Indian Reserve 172 in Blueberry River Indian Band v. Canada (Department of Indian Affairs and Northern Development) - Damages assessed - Entitlement to share in damages disputed - Whether present descendants of the Beaver Band of Indians who are not members of the Doig River Indian Band or the Blueberry River Indian Band are entitled to share in the damages awarded against the Crown. The same 75 individuals later were accepted as members of the Saulteau Band, who claim to be the descendants of the Beaver Band of Indians.

Both individuals, Claire Dean Gauthier, and Lyle Edward Campbell Letendre, under Indian Law, can not speak for the community of Kelly Lake, as they are members of the Saulteau Indian Band.

The Kelly Lake Cree Nation filed a comprehensive land claim in 1996 which is still under the jurisdiction of the Federal Court Claims Division. KLCN filed a civil claim against the Province of British Columbia in 2001. All actions are still pending.
